The Constitutional Court of Andorra urges the conclusion of criminal proceedings due to undue delays
The Constitutional Court of Andorra has upheld an appeal for protection filed by the law firm CORTÉS, ABOGADOS and recognises that, in criminal proceedings against our clients for an alleged offence of money laundering, their fundamental rights to a trial of reasonable duration and to a defence have been violated. It urges the investigating body to complete the investigation phase within six months (despite the fact that Andorran procedural law does not contain any provision similar to Article 324 of our Criminal Procedure Act), which has led to more than six years after the decision to initiate preliminary proceedings and freeze and control our clients’ bank accounts, they are finally being questioned as suspects and, finally, recognises their right to compensation for the abnormal functioning of the administration of justice.
